Please read these Terms of Service ("Terms") carefully before using The Wash Report ("the Service," "we," "us," or "our") operated at thewashreport.com. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
The Wash Report is a web-based software platform that allows automotive dealerships to upload, store, search, and export vehicle wash activity records generated by access-control systems such as SLI Access Control. The Service is intended for business use only.
You must be at least 18 years of age and authorized to act on behalf of a business entity to create an account. By registering, you represent that you meet these requirements. The Service is not intended for individuals under 13, and we do not knowingly collect personal information from children under 13.
To access the Service, you must register for an account by providing your name, email address, and dealership name. You are responsible for:
We reserve the right to refuse registration or terminate accounts at our sole discretion.
New accounts are subject to manual review and activation by our team, which typically occurs within 1–3 business days of submission of your onboarding information. We reserve the right to decline activation without obligation to provide a reason.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
You retain all ownership of the data you upload to the Service, including vehicle wash activity records, CSV files, and any other business data submitted through your account ("Your Data"). By uploading data, you grant us a limited, non-exclusive license to store, process, and display Your Data solely to provide the Service to you.
We do not sell, share, or use Your Data for any purpose other than operating the Service. See our Privacy Policy for details on how data is handled.
Access to the Service requires a paid subscription. Subscription fees, billing cycles, and payment terms are communicated during onboarding and may be updated with 30 days' prior notice. All fees are non-refundable except as required by applicable law. Failure to pay may result in suspension or termination of your account.
Either party may terminate the Service relationship at any time. You may cancel your account by contacting us. We may suspend or terminate your access immediately if we determine, in our sole discretion, that you have violated these Terms or that continued access poses a risk to the Service or other users.
Upon termination, your right to use the Service ceases immediately. We will retain your data for a reasonable period (typically 30 days) after termination, after which it may be permanently deleted. You are responsible for exporting any data you need before termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
We make no representations regarding the accuracy or completeness of data processed through the Service. You are solely responsible for verifying that records stored in the Service are accurate and complete.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE WASH REPORT, ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless The Wash Report and its affiliates, officers, and employees from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Data, or your violation of these Terms.
The Service is hosted on Netlify and uses Neon (a cloud PostgreSQL provider) for data storage. Your use of the Service is also subject to those providers' terms. We are not responsible for the terms, policies, or actions of third-party service providers.
We reserve the right to modify or discontinue the Service or these Terms at any time. Material changes to these Terms will be communicated via email or a notice in your dashboard at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the United States and the state in which The Wash Report operates, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Wash Report regarding the Service and supersede any prior agreements or understandings.
